Who’s Liable in a Rideshare, Uber or Lyft Accident?

Liability always depends on who is at fault for the accident. To prove someone was at fault or in negligent operation, you generally must show the following three elements:

  • The person had a duty of responsibility
  • The person did not live up to their duty of responsibility
  • You were injured due to the breach in responsibility

This means, as a passenger, your rideshare driver or the driver that hit you had a duty of responsibility to drive respectfully following California law.

Do Uber and Lyft Drivers Need to Carry Insurance?

Most rideshare drivers are covered with their personal auto policy, which means if you were a passenger and got hit by another vehicle, you can make a claim against the at-fault party’s insurance carrier.


With that in mind, most personal auto policies do not cover business-usage, which means you (as a passenger) may not be covered for personal injury on their auto policy if you were injured in a rideshare accident because of your driver’s negligence. Because of this, Uber and Lyft have a clause that allows $1 million in liability coverage for their drivers depending on the stage (“period”) the driver is in. If you are a passenger and were hurt, the driver must be in “period three”, meaning the customer (you) is in the car when the accident happens.
